These Terms govern your use of the services offered by SPC HUB S.r.l. under the Guarvian brand. By creating an account or running a free search you accept them. If you are using Guarvian for an agency or company, you confirm you are authorised to bind it.

1. What Guarvian does

Guarvian monitors publicly accessible web pages, file-hosting indexes and public Telegram channels for content matching the stage names and keywords you configure, scores the matches, shows them in your dashboard and, when you ask us to, sends takedown notices (DMCA and equivalent) and search-engine de-indexing requests on your behalf. Guarvian does not host, copy or redistribute the content it finds: results are links and small previews.

2. Eligibility and account

  • You must be 18 or older and provide accurate information.
  • You are responsible for keeping your credentials safe and for all activity under your account.
  • You may only monitor identities you own or are authorised to represent (for example as an agency with the creator's written consent).

3. Takedown notices sent on your behalf

When you request a takedown you declare, under penalty of perjury where the applicable law requires it, that you own the rights in the content listed (or are authorised to act for the owner) and that its publication is not authorised. You appoint Guarvian as your agent for the sole purpose of transmitting the notice. Knowingly submitting a false claim is unlawful and may result in liability to the recipient and in the termination of your account. Guarvian relies on your declaration and does not independently verify ownership.

Guarvian cannot guarantee that a recipient removes content or how fast it does so: compliance depends on the hosting provider, the search engine and the law of the country involved. We report the status of each notice in the dashboard as we receive it.

4. Plans, trial and billing

  • Paid plans are billed in advance through Stripe, monthly or yearly, at the price shown at checkout. Prices are in EUR and may be subject to VAT depending on your country.
  • If a trial period is offered it is stated at checkout, together with when the first charge happens. You can cancel before the end of the trial to avoid being charged.
  • Subscriptions renew automatically. You can cancel at any time from the dashboard; you keep access until the end of the paid period. Plan changes are prorated by Stripe.
  • Monthly result limits, number of stage names and monitored sources depend on the plan, as described on the Pricing page.
  • Refunds are provided where required by law. Consumers in the EU acknowledge that the service starts immediately at their request; the right of withdrawal does not apply to the period already served.

5. Free search

The free search is a limited scan offered without an account to let you check whether content matching a stage name is online. It is rate-limited, shows a capped number of results and may be withdrawn or changed at any time.

6. Acceptable use

  • Do not use Guarvian to monitor, harass or obtain information about third parties who have not authorised you.
  • Do not attempt to access other users' data, reverse-engineer the service, scrape the dashboard, or overload our systems.
  • Do not submit takedown requests for content you do not own or are not authorised to act for.

7. Accuracy of results

Matching is automated and probabilistic: results can include false positives (content that is not yours) and can miss content. You decide which results to act on; you can mark a result as "not mine" to exclude it. Guarvian is a monitoring and notice-transmission tool, not legal advice.

8. Liability

To the extent permitted by law, Guarvian is provided "as is" and our aggregate liability for any claim related to the service is limited to the fees you paid in the twelve months preceding the claim. Nothing in these Terms limits liability for wilful misconduct, gross negligence or where it cannot be limited by law. Mandatory consumer protections of your country of residence remain unaffected.

9. Suspension and termination

We may suspend or terminate an account that breaches these Terms, in particular for false takedown claims or abuse of the service. You can delete your account at any time by contacting support; we will delete your data as described in the Privacy Policy.

10. Governing law and disputes

These Terms are governed by Italian law. Disputes are submitted to the courts of the registered office of SPC HUB S.r.l., without prejudice to the mandatory jurisdiction rules protecting consumers. EU consumers can also use the European online dispute resolution platform.
